Release and Waiver of Liability Agreement

Waiver of Liability

In consideration of the “Participant” being allowed to participate in any way in the Annual CAP Golf Tournament (the “Tournament), and its related events and activities, the undersigned Participant acknowledges, understands, and agrees that:

1. Participation in the Tournament is completely voluntary. The Participant agrees to comply with the stated terms and conditions for participation in the Tournament. If, however, the Participant observes any unusual significant hazard during their presence or participation, the Participant will remove themself from participation and immediately bring such hazard to the attention of the Cathedral Arts Project.

2. The Participant is familiar with the Tournament and the activities in which they will be participating, and the Participant is solely responsible for determining whether their fitness or skill level warrants participation in the Tournament activities. The Participant is aware that these activities may be dangerous and involve the risk of serious injury and/or death and/or property damage. THE UNDERSIGNED KNOWINGLY AND FREELY ASSUMES ALL HAZARDS, DANGERS, AND RISKS, both known and unknown, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES AS DEFINED BELOW OR OTHERWISE and assumes full responsibility for their participation in the Tournament, and its related events and activities.

3. The Participant, for themself, and their respective heirs, assigns, personal representatives and next of kin, HEREBY EXPRESSLY WAIVES AND RELEASES, AND HEREBY AGREES TO INDEMNIFY, DEFEND AND HOLD HARMLESS, the Cathedral Arts Project, its affiliates and any of their respective officers, directors, officials, agents, employees, partners, board members, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the Tournament (collectively, the “Releasees”), WITH RESPECT TO ANY AND ALL CLAIMS, CAUSES OF ACTION, DAMAGES, LOSSES AND/OR EXPENSES ARISING OUT OF OR RELATING TO ANY INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage of any kind to person or property, known or unknown, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, during or related to their participation in the Tournament or its related events or activities, to the fullest extent permitted by law.

COVID-19 Warning

The Cathedral Arts Project has taken enhanced health and safety measures for participants, volunteers, other guests and staff and ask that you follow all posted instructions while participating in the Tournament. However, an inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and guests with underlying medical conditions are especially vulnerable. By participating in today’s event, you voluntarily assume all risks related to exposure to COVID-19.

Media Consent & Agreement

In consideration of the Participant being allowed to participate in any way in the Tournament and its related events and activities, the undersigned Participant consents and agrees to having photographs and/or video taken of them during the Tournament and to having interviews and testimonials solicited from them regarding their participation in the Tournament. The Participant further consents and agrees that said photographs, video, interviews and testimonials may be published in newspapers, television, magazines, publicity releases, the Cathedral Arts Project website, and/or other media sources including social media websites and blogs. Furthermore, the Participant hereby grants to the Cathedral Arts Project full ownership rights, including the rights to copyright the photographs, videos, images, interviews and testimonials in the name of the Cathedral Arts Project, and the rights to use and reuse, publish, and republish the photographs, videos, images, interviews, and testimonial information in whole or in part.

Every child has a creative spirit.

For some, it comes alive through the visual arts: turning blank pages and digital canvases into expressions of hope. For others, it breathes through their bodies – transforming notes, choreography and words into personal statements of joy.

Children develop the technical skills to prepare for these moments through instruction in the arts. Along the way, the arts develop their unique strengths – like self-confidence, creative thinking, self-respect, empathy and perseverance.
